What changed
FMCSA's DataQs website says enhanced requirements for state data reviews took effect September 18, 2026. DataQs lets drivers, carriers and other users ask for a review when they believe federal or state crash or inspection data stored by FMCSA is incomplete or incorrect.
The requirements come from an April 16 Federal Register notice tied to Motor Carrier Safety Assistance Program grant funding. The document is a notice announcing revised DataQs requirements for participating states; it is not a new CDL law or a final rule changing the Federal Motor Carrier Safety Regulations.
Three review stages and set timelines
States must use three independent stages: Initial Review, Reconsideration and Final Review. An issuing officer or inspector cannot be the sole decision-maker when an initial review ends with no correction. Reconsideration reviewers must be separate from the initial decision-maker, and final reviewers cannot have participated in either earlier decision.
The state must open an initial Request for Data Review within seven calendar days and communicate an initial decision within 21 days. A reconsideration decision is due within 21 days, and a final-review decision within 45 days. A requestor has 30 days after the prior decision to seek reconsideration or final review. If the state asks the requestor for relevant additional information, the requestor generally has 14 days and the state's decision clock pauses during that response period.
What it means for drivers and carriers
Company drivers and leased owner-operators may file their own requests; use is not limited to a motor carrier. The revised state requirements also call for acceptance of inspection-related requests submitted within three years of the inspection and crash-related requests submitted within five years of the crash.
A DataQs request does not guarantee a correction. Drivers and carriers should keep inspection reports, court dispositions and other relevant records, explain the claimed factual or legal error, and watch the new appeal deadlines. The official DataQs page should be used to sign in and confirm current instructions before submitting a request.
